Terms and Conditions

1. Identifying information

This website, accessible at forekast.com (hereinafter, the "Site"), and the associated mobile application (hereinafter, the "App") are part of the Forekast project, currently in pre-launch and operated by its promoters from Spain.

For the purposes of Regulation (EU) 2016/679 (GDPR) and Spanish Law 34/2002 on Information Society Services (LSSI-CE), the contact details are:

Forekast is in pre-launch. These Terms will be updated when the legal entity that will own the service is incorporated, at which point the full identifying information (corporate name, registered address and tax ID) will be added. Until then, the obligations arising from the use of the Site and the App rest with the promoters of the project.

2. Purpose and acceptance

These Terms govern access to and use of the Site, the App and the associated services (hereinafter, the "Service"). Accessing the Service implies the express, full and unreserved acceptance of these Terms. If you disagree with any of them, you must refrain from using the Service.

3. Nature of the Service

Forekast is an information, analysis and social-network platform focused on prediction markets operated by third parties such as Polymarket, Kalshi and similar platforms (hereinafter, the "Operators").

For the avoidance of doubt, Forekast is not:

• a gambling operator nor a sportsbook;
• an investment-services entity, financial advisor or portfolio manager;
• a payment institution, fund custodian or financial intermediary;
• a copy-trading service that executes trades on behalf of the user.

Forekast does not accept positions, does not custody user funds and does not execute trades on the user's behalf. Every operation is carried out by the user directly on the relevant Operator's platform, subject to the terms and regulation applicable to that Operator.

4. Access and registration

Basic access to the Service is free of charge. Some functionalities require prior registration. To register:

• You must be of legal age (18 in Spain).
• You must provide accurate, current and complete information.
• You are responsible for keeping your credentials confidential and for all activity carried out under your account.

Forekast may deny, suspend or cancel access for any user who breaches these Terms, without prior notice.

5. Acceptable use

The user agrees to use the Service in accordance with the law, public order, generally accepted standards and these Terms. The following is expressly prohibited:

• publishing false, manipulated or unverifiable track-record information;
• impersonating other users or third parties;
• using the Service to direct users toward operators that are unregulated or illegal in their jurisdiction;
• reverse engineering, mass scraping or any unauthorised extraction of data from the Service;
• publishing unlawful, offensive, defamatory, misleading or rights-infringing content;
• using the Service as a vehicle for money laundering or financing illegal activities.

6. User-generated content

Users may publish analysis, positions and other content through the Service. The user warrants that they hold the necessary rights to the content they publish and grants Forekast a non-exclusive, worldwide, royalty-free licence to host, display and distribute that content through the Service.

Information published by a user reflects only their personal opinion and does not constitute, in any case, financial advice, investment recommendations or solicitations to trade. Any decision made by third parties based on that content is the sole responsibility of the user making the decision.

7. Third-party services and external links

The Service includes references, links and data related to platforms operated by third parties (Polymarket, Kalshi and others). Forekast does not control, supervise or assume responsibility for the availability, content, business practices or applicable regulation of those platforms. The contractual relationship between the user and each Operator is governed exclusively by the Operator's own terms.

8. Intellectual and industrial property

All elements that make up the Service (brand, logos, code, design, text, databases, data aggregations) are owned by Forekast or duly licensed to it. Their reproduction, distribution, public communication or transformation without express authorisation is prohibited.

9. Limitation of liability

The Service is provided "as is" and "as available", in pre-launch. To the fullest extent permitted by applicable law:

• Forekast does not warrant the accuracy, completeness or real-time updating of the information shown, given that it comes from third-party sources.
• Forekast is not liable for financial losses, consequential damages or loss of profit derived from trading decisions made by the user.
• Forekast is not liable for failures, interruptions, downtime, attacks or data loss attributable to hosting providers, third parties or force majeure.

Nothing in these Terms excludes liability for wilful misconduct, gross negligence or any other liability that cannot be excluded under applicable law.

10. Suspension and account closure

Users may request the closure of their account at any time from the App settings or by emailing [email protected]. Forekast may suspend or cancel accounts that breach these Terms without prior notice, retaining only the data strictly necessary to evidence the conduct.

11. Modifications

Forekast may modify these Terms at any time. Material changes will be communicated to the user by email or by a clearly visible notice on the Service at least thirty (30) days in advance, except where the change is required by mandatory law or for security reasons.

12. Governing law and jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals of the consumer's domicile, in accordance with article 90.2 of Spanish Royal Legislative Decree 1/2007 on the protection of consumers and users.

Pursuant to Regulation (EU) 524/2013, consumer users may access the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
